LIABILITY WAIVER FOR MUSIC TOGETHER OF PORTLAND CLASSES
 

COVID-19 ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY. As a willing participant in Music Together® classes at Music Together of Portland LLC, my family and I agree to the following:
 

ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at Music Together of Portland LLC, and present an inherent risk that cannot be eliminated. I acknowledge that, although Music Together of Portland LLC  is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including Music Together® teachers, and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children. I understand and agree that as a registered family with Music Together of Portland LLC, I am accepting and voluntarily assuming the risk that my child or I may be exposed and become ill as a result of COVID-19 and other diseases.
 

WAIVER OF LIABILITY: I, on behalf of myself and my children, hereby voluntarily release, forever discharge, and covenant not to sue Music Together of Portland LLC and its owners, managers, contractors, members, employees, agents, and volunteers, or the location owner (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus (COVID-19) or any other accident that may cause harm. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties.

I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES AT MUSIC TOGETHER OF PORTLAND LLC, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.

 

GENERAL TERMS AND CONDITIONS

 

In-Person Classes: Class size / Mask usage Maximum 12 children per class. Babies under 9 months do not require a seat. However, all children attending class must be enrolled. Masks are not required in class, but are always welcome.

  

Distancing There will be room to spread out in classes. Folks are welcome to move in a bit closer when invited by their teacher to do so (such as during a circle dance), or to remain in their own family space and modify activities according to their comfort. 

 

Health Assessment Before you leave home... Please do a quick health assessment and stay home if you or anyone living in your home is showing any of these symptoms of illness, including fever, sore throat, cough, shortness of breath, difficulty breathing, or other respiratory symptoms. Please stay home and contact Julie ([email protected]) if you or anyone who has attended class tests positive for COVID-19 within 48 hours of attending class. If there is a known in-class exposure, we will contact affected families. In addition, we ask that each family do their part in keeping our community healthy by following our family health protocols.

 

Make-up Classes There will be make-up classes available throughout the session for families who miss a class due to travel, illness, etc. Each family is allowed 2 make-up classes per session. Make-ups can be scheduled through the Family Portal on the Enrolled Families section of the website. These make-up classes have limited availability and are not guaranteed. There will be no refunds or credits given for missed classes.

 

Class Cancellations If a class is canceled due to inclement weather or teacher illness, we will make every reasonable effort to provide a make-up class, based on teacher and classroom availability. In the event of a natural disaster or community crisis requiring Music Together of Portland's closure, we will make every attempt to offer make-up classes, but we are unable to refund classes that are canceled for reasons beyond our control.

 

Refund Policy No tuition refunds are given after the current session begins. Once confirmed in a class, an administrative fee of $25.00 will be deducted for withdrawals if enrollment is cancelled before the session begins. Opened materials cannot be refunded/returned and must be purchased.

 

Oregon State Mandates Though it is unlikely that classes would move to Zoom, we may switch to online classes if Oregon State and/or Multnomah County mandates a change in current COVID-19 protocols. There will be no refunds or credits due to classes moving online.

 

Injuries Parents, legal guardians of minor students and adult students waive the right to any legal action for any injury sustained at Music Together of Portland LLC venues resulting from normal class activity or any other activity conducted by families before, during, or after class time.

 

PLEASE NOTE: You are responsible for ensuring that any adult who brings your child to class has read and understood the policies, procedures, and waiver prior to attending class! 

 

Music Together of Portland reserves the right to modify and update policies according to CDC and state guidelines as new information and guidance become available.
